Terms of Service

These Terms of Service (“Terms”) govern skybearlabs.com (the “Site”) and SkyBear Labs apps that link to these Terms, including Daily Czech (the “Apps”). They are operated by SkyBear Labs LLC (“SkyBear Labs,” “we,” “us,” or “our”). By using the Site or Apps, you agree to these Terms.

Consulting and custom development

Our consulting and custom development engagements are governed by a separate written agreement, such as a proposal, statement of work, or master services agreement signed by both parties. That agreement controls the scope, fees, deliverables, timelines, warranties, and other terms of that engagement if it conflicts with these Terms.

Using our apps

Subject to these Terms and applicable app-store rules, we grant you a limited, non-exclusive license to install and use the Apps for their intended purposes on devices you own or control. This does not transfer ownership of the Apps or their content. Separate licenses for open-source software and third-party materials continue to apply. Nothing here restricts rights that applicable law does not allow us to restrict.

Use the Site and Apps lawfully. Do not interfere with their operation, bypass access controls, distribute malicious code, or access another person’s data without authorization. You can stop using an App by uninstalling it. Uninstalling does not necessarily remove device backups or cancel an app-store subscription.

Educational content and everyday tools

Daily Czech provides language-learning material for practice and general education. We aim for accuracy but do not guarantee that every translation, pronunciation, or explanation is complete or error-free, or that using the App will produce a particular learning result. It is not a certified translation service.

Where an App provides reminders, delivery can depend on device settings, permissions, battery restrictions, and operating-system behavior. Maintain your own arrangements for time-critical tasks. Educational and utility content is not a substitute for professional advice where that is needed.

Pricing and app stores

An App’s store listing and purchase screen describe any price, paid features, or subscription terms before you purchase. A free download does not promise that every future feature will be free. This section does not mean every App offers purchases or subscriptions. App-store payment, cancellation, and refund rules apply to transactions through that store, together with your rights under applicable law. Accepting these Terms does not itself authorize any future charge.

Applicable distribution-platform terms also apply. Where an app store supplies a separate end-user license agreement for an App, that agreement governs its license; these Terms apply to our services to the extent consistent with that agreement.

Privacy and your data

See our privacy policies for how we handle information. Daily Czech users should read the Daily Czech privacy policy, including instructions for removing local learning data and managing backups. You retain any rights you have in information you provide; these Terms do not transfer ownership of that information to us.

Availability and updates

We may update, modify, suspend, or discontinue the Site or Apps. Features and availability may change, subject to applicable law and commitments made for a purchase. We will provide notice where required. Keep your device and Apps up to date for security and compatibility.

Intellectual property

The Site, Apps, and their content, including text, graphics, logos, and the SkyBear mascot, are owned by SkyBear Labs LLC or their respective licensors and protected by applicable laws. Except as permitted by these Terms, a separate license, or applicable law, you may not copy, reproduce, or redistribute that content without permission.

No warranty

To the extent permitted by law, the Site and Apps are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant uninterrupted, error-free, or secure operation. Information is for general purposes and does not constitute professional advice. This does not affect statutory guarantees that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, SkyBear Labs LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from use of the Site or Apps. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

Governing law

These Terms are governed by California law, without regard to its conflict-of-laws rules. Disputes are subject to the jurisdiction of state and federal courts in California, except where applicable law entitles you to another forum. Mandatory consumer protections in your place of residence remain unaffected.

Changes to these Terms

We may update these Terms and revise the effective date above. Changes take effect when posted unless a later date is stated. We will provide additional notice or obtain agreement where required by applicable law.
